What is the minimum wage? Under legislation contained in the National Minimum Wage Act 1998, AND THE NATIONAL Minimum Wage Regulations 1999, all employees over the age of 18 have a right to a National Minimum Wage. As at March 2003, this is set at: · Adult rate for workers aged 22 and over £4.20 per hour · Development rate for workers aged 18 – 21 £3.60 per hour The only exceptions to National Minimum Wage legislation are employees who are in accredited training – working towards qualification leading to NVQ or equivalent. What are the Working Time Regulations? From October 1st 1998, it became illegal for any employed person to work over 48 hours per week. Employers should take all responsibility to ensure that over a seventeen-week period, workers are not required to work over this limit unless they have signed an “opt out” agreement. What is the difference between a Foundation and Advanced Modern Apprenticeship? Very little in terms of the way the training is delivered. And both follow industry-defined frameworks. Foundation Modern Apprentices work towards NVQ level 2. Advanced Modern Apprentices work towards the achievement of level 3. What is ' Time Off ' for Study or Training? As a result of an amendment to the Employment Rights Act 1996, young people in employment aged 16 – 17 with educational qualifications below 5 GCSEs at grade C have the right to reasonable time off to study to enable them to achieve NVQ level 2 or equivalent.
